Your Rights Under The Fair Debt Collection Practices Act
Debt is an ongoing fact of life for many people. When you can’t pay your bills or make ends meet, the last thing you need is more stress and pressure from debt collection agencies. The debts they’re trying to collect might not even be accurate.
Federal law – specifically, the Fair Debt Collection Practices Act (FDCPA) – places limits on what debt collectors can do. It also gives you important rights and a way to pursue compensation for debt collection violations.
At Madgett Law, we can advise you of those rights and help you take action against debt collectors who violate the law. Our Minneapolis-based lawyers have decades of experience holding financial institutions such as debt collection agencies and credit bureaus accountable. We’re committed to helping people take charge of their credit and debt.
What Debt Collectors Can’t Do
The FDCPA makes it illegal for debt collectors to:
- Harass you
- Call you before 8 a.m. or 9 p.m. (local time)
- Contact your employer
- Post publicly about you on social media
- Misrepresent your debt or lie to you
- Threaten legal action or other consequences that they can’t actually pursue
- Discuss your debt with third parties (except in limited circumstances)
- Pursue fees or debts that aren’t legal
- Continue contacting you after you’ve notified them in writing that you don’t want any further communication
- Continue contacting you for a period of time after you’ve requested to verify the debt
- Continue contacting you once you have an attorney
If a debt collector has violated your rights, you can take them to court and pursue financial compensation for FDCPA violations. Our attorneys can help you with that. We’re familiar with many of the most common violations of the FDCPA.
